This document outlines the Terms of Service (the “Terms”) for using Clicksambo’s click fraud detection and prevention software (the “Service”). By accessing or using the Service, you (“You” or “User”) agree to be bound by these Terms. If you disagree with any part of these Terms, you may not use the Service.

1. Definitions

Account: Your unique account on the Clicksambo platform, accessible with your username and password.
Click: A single instance of a user clicking on an online advertisement.
Click Fraud: Malicious activity where individuals or bots generate fraudulent clicks on ads to inflate costs for advertisers.
Clicksambo: Medyzone Danismanlik AS, the owner and operator of the Service.
Client Code: The Clicksambo software code installed on your website to monitor click activity.
Reports: The information and data generated by Clicksambo, showing detected click fraud and other metrics.
Service: Clicksambo's click fraud detection and prevention software, accessible via Clicksambo's website.
Website: The webpage(s) that you own or control, where the Client Code is installed.

2. Account Policy

Registration: You must create an account to use the service. You are responsible for providing accurate and complete information during registration.
Account Security: You are responsible for maintaining the security of your account and password. Clicksambo is not responsible for any loss or damage resulting from unauthorized access to your account.
Prohibited Use: You may not use the service for any illegal or unauthorized purpose, or violate any applicable laws.
Termination: Clicksambo reserves the right to terminate your account at any time for any reason, without notice.

3. Usage

License: Clicksambo grants you a limited, non-exclusive, non-transferable license to use the service and client code solely for your own website(s).
Internal Use: You may only use the service and reports for your internal business purposes. You may not share the service or client code with third parties.
Compliance: You agree to comply with all applicable laws and regulations in your use of the service.

4. Billing

Subscription: You may choose a subscription plan for the service. Payment is made in advance according to your chosen plan.
Automatic Renewal: Your subscription automatically renews on the renewal date, and your payment method will be charged.
Non-Refundable: All charges are non-refundable. If you cancel your subscription, you will not be charged any new fees, but you are responsible for all past-due amounts.

5. Cancellation

Cancellation Request: You can cancel your subscription at any time by contacting Clicksambo customer support.
Trial Period: If you are using a free trial, you must cancel your subscription before the trial period ends to avoid being charged.

6. Third Parties

Third-Party Access: You are responsible for any third-party access to your account or use of the service.
Third-Party Data: If you use the service on behalf of a third party, you must ensure they are bound by these terms.

7. Proprietary Rights

Ownership: Clicksambo owns all rights, title, and interest in the service, client code, and all related materials.
Limited Use: You are granted a limited license to use the service and client code in accordance with these terms. You may not copy, modify, or distribute any part of the service or client code without Clicksambo’s express written permission.

8. Disclaimer of Warranties

'As is' basis: The service is provided 'as is' and without any warranty of any kind, express or implied.
No warranties: Clicksambo disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
No liability: Clicksambo is not liable for any damages arising from your use of the service, including but not limited to loss of data, profits, or business.

9. Limitation of Liability

No liability for click fraud: Clicksambo is not liable for any click fraud detected or not detected by the service.
Limited liability: Clicksambo’s total liability to you for any damages arising from these terms will not exceed the amount you paid for the service.
No warranty of results: Clicksambo does not guarantee any particular results from using the service.

11. Miscellaneous

Governing Law: These Terms are governed by and construed in accordance with the laws of Estonia.
Entire Agreement: These terms constitute the entire agreement between you and Clicksambo regarding your use of the service.
Changes to Terms: Clicksambo reserves the right to modify these terms at any time. You are responsible for reviewing the terms periodically.
Severability: If any provision of these terms is held to be invalid or unenforceable, such provision will be struck from these terms and the remaining provisions will remain in full force and effect.
